Our office is now offering free consultations for individuals who may qualify for or who would like to learn more about the Provisional Unlawful Presence Waiver.
This new final rule has changed the process by which certain individuals may obtain a provisional unlawful presence waiver. Under the final rule, these certain individuals will be able to apply for a provisional unlawful presence waiver before they depart the United States to attend their immigrant visa interviews in their countries of origin.
Please keep in mind that in order to qualify for the Provisional Unlawful Presence Waiver, the individuals must meet the following criteria:
1. The individual must be an immediate relative of a U.S. citizen (an immediate relative is a spouse, child, or parent)
2. The individual must only be inadmissible only on account of the unlawful presence
3. The individual must be able to demonstrate that a denial of the provisional unlawful presence waiver would result in extreme hardship to his or her U.S. citizen spouse or parent
