As a current or former battered spouse, parent, or child you may obtain lawful permanent status (“Green Card”) in the United States through VAWA. VAWA allows spouses, parents, and children of U.S. citizens and lawful permanent residents (“Green Card Holders”) who are victims of domestic violence to file an immigration petition for themselves, without the abuser’s knowledge.
VAWA permits victims of domestic violence to seek safety and independence from their abuser by obtaining lawful status in the U.S. on their own and not tolerating abuse out of fear of deportation. Eligibility for VAWA Petition
If your VAWA petition is approved, immigration will permit you to reside and work in the United States. With a VAWA approval you may also apply for lawful permanent residence status (“Green Card”). The VAWA petition path leads to citizenship in the United States and our law firm is committed to assisting you at every step until you become a United States Citizen.
You are eligible to file under VAWA if you lived with the abuser at some point and if:
- You are or were abused by your U.S. citizen or lawful permanent resident spouse (or if that spouse has abused your child)
- You are or were abused by your U.S. citizen or lawful permanent resident parent (including step-parent) or
- You are or were abused by your U.S. citizen adult son or daughter
